Protecting your privacy
At The Humour Foundation (‘we’), we are firmly committed to protecting the privacy of any personal information we collect about you and we aim to maintain a safe and secure system of handling your information. We seek to ensure that your personal information is handled in accordance with all applicable laws, including the Australian Privacy Principles in the Privacy Act 1988 (Cth).
This privacy policy details how we handle your personal information and how you can exercise your privacy rights.
What information do we typically collect and hold?
We typically collect and hold the following types of information about individuals:
- name
- contact details (e.g. address, phone number, email address)
- identification details (e.g. date of birth)
- payment details (e.g. credit card numbers or bank details)
- details of interactions and activity (e.g. communications, enquiries, complaints, participation in our programs, transactions and activity relating to us)
- preferences, interests and opinions (e.g. preferences about communications with us)
in addition, in relation to staff, contractors, volunteers and job applicants:
- experience, qualifications, skills and character
- screening checks (e.g. references, background, identity, eligibility to work, vocational suitability, vaccinations and criminal record checks)
- conduct and performance at work
- use of workplace resources and IT
- incident reports
- payroll and superannuation details (but not for volunteers)
- emergency contacts
- limited health information to meet hospital or facility requirements if required

- your profession
- donation and transaction details.

If you book an online session with our Clown Doctors:
- Child’s age
- Patient status of child (inpatient, outpatient etc.)
- Name of the hospital where treatment is being received (optional)
- Other health information (not generally requested but may be provided to us
e.g. by the parent/carer).
In certain circumstances, we may collect sensitive information about you. For example, an individual may provide us with health information when requesting a program or in relation to a donation appeal. Our Clown Doctors and Laughter Care performers may update us after they visit you and tell us about the interaction, using your first name only. Importantly we only collect, use and disclose sensitive information with consent or otherwise in accordance with law.
We also collect some personal information pursuant to applicable laws, including the Income Tax Assessment Act and other tax laws, Corporations Act, Fair Work Act, Superannuation Guarantee (Administration) Act, occupational health and safety acts and workers compensation acts.

How do we collect your information?
We generally collect personal information directly from the relevant individual or their authorised guardians. In some cases, we collect personal information in other ways including:
- records of communications, including with our staff or contractors (e.g. phone, email, website, social media);
- records of activity (e.g. website usage or through IT system or other surveillance);
- publicly available information;
- by generating new personal information (e.g. reports or analysis based on other information we hold about you); and
- from our third-party service providers.
Where you provide us with personal information about someone else you must have their consent to provide their personal information to us based on this Privacy Policy.
What purposes do we handle your information for?
We may collect, hold, use and disclose your personal information to:
- deal with your enquiries and requests
- provide you with services (e.g. our Clown Doctors or Elder Clowns)
- receive and administer your donations
- operate our organisation
- provide and improve our programs
- maintain and update our records
- communicate with our stakeholders including our donors, supporters, fundraisers and corporate partners
- personalise your experience with us
- recruit, train and manage our people
- protect the safety and security of our people, sites and property
- comply with our legal obligations (e.g. where we receive a subpoena) and protect and defend our legal rights and interests
- manage any transition of our operations to another entity, or vice versa, or as otherwise permitted or required by law.
We may not be able to do these things without your personal information. For example, we may not be able to communicate with you, deal with your enquiries or provide our programs to you. For staff, we may in some cases take disciplinary action including termination if you refuse to provide important information.
Direct Marketing
We also handle personal information to communicate with our stakeholders including our current and past donors, supporters, fundraisers, corporate partners and individuals who have been involved in one or more of our services or programs.
Sometimes we communicate with potential donors, individuals or corporations whose contact details we have obtained from fundraising events or publicly available information on the internet or in publications. We may communicate with you for promotional purposes or our donation campaigns either by telephone (during normal business hours), mail or by email. If, however you do not wish to be contacted, you may withdraw consent at any time by using the contact details below.
Do we disclose any information to outside parties?
Yes, we may share personal information with outside parties. This might include to government agencies for lawful purposes (e.g. tax and work cover authorities) or if required to do so under state or federal law (including to the Australian Information Commissioner).
If you apply for a position with us (whether as an employee, volunteer or a contractor), we may exchange your personal information with screening check providers, health service providers, professional and trade associations, law enforcement agencies and referees (including your current and previous employers). In addition, if you go on to work with us, we may exchange your personal information with your representatives, other employers seeking a reference about you and our service providers including providers of payroll, superannuation, banking, staff benefits and training services.
We exchange personal information with our contractors and service providers that assist in the operation or administration of our organisation from time to time (for example, our donation and fundraiser collection agencies, mailing house, internet, data storage, auditing, accounting, legal, business consulting, delivery, research and technology providers). We also exchange personal information with your and our representatives.
The outside parties we share personal information with may be located in the USA and other countries. We are required to comply with strict privacy requirements where we disclose personal information to recipients outside Australia.
We also use a service called Mailchimp to create and deliver certain emails, and provide related services including mailing list management and segmentation. Mailchimp (and its contractors) use cookies, web beacons and flash player codes and collect and handle personal information as described in its Privacy Policy available at mailchimp.com/legal/privacy and Cookie Statement available at mailchimp.com/legal/cookies.
What do you need to know about privacy on our website?
If you use our website to read, browse or download information, our system may record information such as the date and time of your interaction, the pages accessed and any information downloaded. This information is used for statistical, reporting and website administration and maintenance purposes.
Like many other websites, our website may use ‘cookies’ from time to time. A cookie is a piece of information that allows our system to identify and interact more effectively with your browser. The cookie helps us to maintain the continuity of your browsing session and remember your details and preferences when you return. You can configure your web browser software to reject cookies however some parts of our website may not have full functionality in that case.
How do we protect the security of your personal information?
We are required by law to take reasonable steps to maintain the privacy and security of personal information. We use a range of measures to do this in respect of both hard copy and electronic records, including [building security, access restrictions, network firewalls and contractual protections where our service providers store this information on our behalf.
How can you request access or correction of your personal information?
You can request access or correction of your personal information that we hold. Please provide as
much detail as you can about the particular information you seek, in order to help us locate it.
We will not charge you for making a request to access your information, but we might charge you a reasonable fee for giving you access to such information. We will let you know in advance if any charges will apply.
If we are unable to provide the access or corrections you seek, we will (subject to applicable law or where it is unreasonable to do so) let you know why. If you disagree in relation to a correction that we have refused, you can ask us to note your requested correction with the information.
How can you complain about handling of your personal information?
You can make a complaint directly to us if you feel we have breached your privacy. We may seek further details from you and may need to engage or consult with other parties to investigate and deal with your complaint. We will keep records of your complaint and any resolution.
